Bushra Bibi Nikah, the founder of PTI, had her case moved to a different court.

According to information, the matter has been moved to Judge Muhammad Afzal Majoka of the Additional District and Sessions Court.

After Khawar Manika raised an objection, Session Judge Shahrukh Arjumand wrote a letter to the Chief Justice of the Islamabad High Court asking the case’s transfer.

Afzal Majoka, an Additional District and Sessions Judge, will now hear appeals against the sentence in the Nikah case following the approval of the transfer petition.

Session Judge Shahrukh Arjumand was asked to transfer Khawar Maneka’s case to another judge during the most recent hearing on May 29 because Maneka “don’t want the case verdict from you.”

Message to the High Court

The continuing Nikah case involving Imran Khan and Bushra Bibi was later the subject of a letter from Session Judge Shahrukh Arjumand to the High Court.

Khawar Manika has voiced no confidence against the judge during today’s hearing, according to the judge’s letter.

Additionally, the judge noted that on April 30, 2024, Khawar Maneka’s request was earlier denied.

He claimed that by making up excuses, the complainant’s attorney has consistently attempted to stall the proceedings. Raising particular objections against the presiding officer is deemed inappropriate by the judge.

Both parties’ arguments were heard in-depth in this instance, according to Arjumand.

In addition to asking that the appeals be transferred to any other court with jurisdiction over this issue, he also asked the High Court to establish a deadline for the appeals’ resolution.

Matrimony between Imran Khan and Bushra Bibi
In February 2018 in Lahore, the former prime minister wed Bushra Bibi.

Only the bride’s mother and immediate family members and friends were present for the ceremony. The sisters of the founder of PTI, however, were not there.

The nikah was done by Mufti Saeed with witnesses Awn Chaudhary, a former leader of the Pakitan Tehreek-e-Insaf (PTI), and Zulfi Bukhari, a former SAPM.

Former spouse of Bibi, Khawar Maneka, had petitioned the court last year, arguing that the marriage violated Sharia law and was unlawful.

The initial accusation against Imran Khan and Bushra Bibi was that they were married during the three-month “iddat period” that comes after a divorce. Maneka has further accused them of infidelity.

Judge Qudratullah declared the case’s reserved ruling in the “un-Islamic” nikah lawsuit against Imran Khan and former First Lady Bushra Bibi.

The court imposed a seven-year prison term and a Rs. 500,000 punishment on both PTI founder Imran and Bushra Bibi.

In the Toshakhana-2 case, IHC sends notices regarding Imran Khan and Bushra Bibi’s acquittal pleas.

In response to the petitions for acquittal filed by Bushra Bibi and Imran Khan, the founders of the Pakistan Tehreek-e-Insaf (PTI), in the Toshakhana-II case, the Islamabad High Court on Thursday sent notifications to the Federal Investigation Agency (FIA) and other parties.

Hearing the applications was Justice Raja Inam Ameen Minhas of the IHC. The judge said that there is no legal precedent for halting criminal proceedings at this point when Salman Safdar, Imran Khan’s attorney, requested a stay order on the trial in the Toshakhana-2 case during the hearing.

The court would also hear the other party and send notices regarding the petition, Justice Minhas noted.

Since Justice Gul Hassan Aurangzeb had previously heard five petitions pertaining to this case, Safdar later also filed a motion to transfer the case to another bench, stating that it would be proper to send the acquittal petitions to him for additional hearing.

According to Justice Minhas, who dismissed his plea, the petitions considered by Justice Aurangzeb were bail requests. This was a different issue, he remarked, and he would consider the case. He gave the attorney instructions to argue the case’s merits.

The PTI lawyer later pleaded the high court to halt proceedings of the trial court. The judge replied that suspects had already been indicted, and witnesses were testifying.

He noted that it would not be appropriate to issue any such order at this stage, adding that he would issue notices and the case would not be adjourned for a long period.

The court then issued a notice to the FIA and adjourned the hearing until Jan 28.
