In order to obtain a share, LHC requests the woman’s proof of claim over the property.

The Lahore High Court (LHC) has postponed making a ruling on a request to purchase real estate under the Women Protection Act. Both sides’ arguments were heard at the hearing, which was presided over by Justice Muzammil Akhtar Shabbir.

The applicant, Afaq Yasmin Khan, asserted that a property under DHA was not giving her her just share. She claimed that the female provincial ombudsman rejected her application without considering her complaints, and she asked the court to overturn the ombudsman’s ruling.

Throughout the hearings, Justice Shabbir emphasized how crucial it is to support the claim with evidence of ownership or inheritance. “Without proof of entitlement, you cannot assert your claim to a property,” the judge said.

“Without any evidence, how can someone give you property? One may even assert ownership of Minar-e-Pakistan or Badshahi Mosque if such claims were accepted without evidence, the court noted, emphasizing the lack of any legal provisions bolstering irrational assertions.

The petitioner was instructed by the court to provide legitimate parental inheritance documentation in order to prove her claim. Following a consideration of the evidence and arguments presented, the verdict will be made public.
