The high court delivered a written order on Chief Minister Gandapur’s plea against the election commission’s disqualification notice.
“The Supreme Court interpreted clause 62-1(f) in the Nawaz Sharif case,” the court decision stated.
“After the election tribunal established, the election commission has not been empowered to proceed,” the text of the order read.
The court judgment states that the election commission has no authority to take action against the petitioner.
The parties are being given preliminary notice. The election commission’s disqualification notice action has been declared suspended, according to the order.
The Peshawar High Court recently delayed the ECP’s disqualification proceedings against Ali Amin Gandapur.
The court issued notices to the parties and requested a response.
A high court bench consisting of Justice Ijaz Anwar and Justice Waqar Ahmed heard the plea.
