SC upholds death sentence of ex-wife’s killer
– A three-member bench of the Supreme Court has dismissed a petition of a convict and upheld death sentence against him.
Convict Waseem Abbas had filed a petition against death sentence he go for killing his wife after she exercised her right to seek divorce from a family court.
Justice Muhammad Hashim Khan Kakar issued a detailed four-page judgment.
According to the Supreme Court, the Constitution of Pakistan has given a woman the right to seek divorce and violence against her is an attack on the Constitution, and law will deal strictly with those who torture a woman seeking divorce.
The SC decision states that Articles 9, 14, and 25 of the Constitution provide women with complete protection and equal rights.
Killing a woman for demanding her legal rights is open rebellion and brutality against the law, it said.
According to the Supreme Court, the perpetrator does not deserve any concession in such cold-blooded and premeditated murder. The testimony of relatives cannot be rejected in a crime committed within domestic boundaries.
According to the decision, the forensic match between the shell casing and the pistol found at the scene is indisputable evidence of the crime.
There is no flaw in the decision of the subordinate courts, and the death penalty will be upheld, SC decided.
It should be noted that on October 11, 2020, accused Waseem Abbas shot at and killed his ex-wife Shahnaz Bibi. She had obtained a legal degree of divorce from the family court, but 48 hours after receiving the divorce decree, the accused entered the house of the woman and killed her.
The trial court sentenced the accused to death and 10 years in prison. The Lahore High Court also upheld the death sentence of the accused.
